Referral Program Terms of Service

The ReliableMerchants referral program is provided "as is," with no guarantee of desired functionality. All referral program users certify that they understand and consent to the following:


1 - Enrollment. You understand that your enrollment in the ReliableMerchants referral program may initiate a plurality of requests to your auction house by you through ReliableMerchants that is comprised of the following steps:
a. Access your feedback profile
b. Have customer information extrapolated from your feedback profile
c. Have a percent of your past and pending future customers emailed

2 - Emailing. You understand that ReliableMerchants may contact a portion of your past and pending future customers with referral notes, but will not add their email addresses to a periodically updated email list or sell any of said email addresses to a third party.

3 - Payment Process. You understand that ReliableMerchants will immediately place $8 as pending in your ReliableMerchants account when any customer of yours that receives the referral email registers with ReliableMerchants.

3b - Detailed Payment Process. You understand that the moneys mentioned in section 3 of this agreement are only pending, and their issuance by ReliableMerchants to you will be dependant upon whether a referred registrant remains with ReliableMerchants for more than one month, whereby if the customer does remain with ReliableMerchants for more than one month the money will then be fully issued to you at the time of the customer's first subscription payment, and if either you or your customer cancels a ReliableMerchants subscription before one month the funds will not be remitted to you and will no longer be pending.

4 - Indemnification. You understand that since by enrolling in the ReliableMerchants referral program you are initiating the request to have a portion of your past and pending future customers emailed, you surrender your right to hold ReliableMerchants responsible for any repercussions of these emails, or to have others do the same on your behalf. Specifically, you, or a party acting on your behalf, indemnify ReliableMerchants and our subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising from referral emails, referral payments, or the referral program in general. Moreover, you indemnify ReliableMerchants from from legal and monetary repercussions relating to loss of business, tarnished reputation, account suspension, account warnings, SPAM, or any hypothetical consequence of these emails.

5 - Arbitration. As set forth in the ReliableMerchants site Terms of Service, any controversy or claim arising out of or relating to this Agreement or our services shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Manhattan, New York, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Either you or ReliableMerchants may seek any interim or preliminary relief from a court of competent jurisdiction in Manhattan, New York necessary to protect the rights or property of you or ReliableMerchants pending the completion of arbitration.


This ("this") user agreement may be changed at any time. Depending upon the notification preferences chosen during the registration process  members may be notified 10 days in advance of upcoming changes to the terms of service and will be given the option of inactivating their community membership. Use of this web-site, and enrollment in any ReliableMerchants program, constitutes acceptance of the above-listed terms of service.
